You acknowledge and agree that your use of the platform is subject to the following:

 

- You will not use the platform for any illegal or unauthorized purpose;

 

- You will not use the platform in any way that could, in Digital Engine's sole discretion, damage, disable, overburden or impair the platform;

 

- You agree not to access (or attempt to access) the platform by any means other than through the interface that is provided by Digital Engine;

 

- You agree not to access (or attempt to access) the platform through any automated means (including, without limitation, the use of scripts or web crawlers);

 

- You agree not toengage in any activity that interferes with or disrupts the proper working of the platform (or the servers and systems which are used to provide the platform);

 

- You agree not to reproduce, duplicate, copy, sell, resell, distribute or exploit, any part of the platform without the express written permission of Digital Engine;

 

- You agree not to access, collect or store any personally identifiable information from the platform or from other users of the platform;

 

- You agree not to upload, post, transmit or otherwise make available on the platform any viruses, worms, or other harmful code or material;

 

- You agree not to solicit, for commercial purposes, any other user of the platform; and

 

- You agree not to violate any applicable law or regulation.

 

If You breach any of the terms and conditions in this Agreement, Your permission to use the platform may be terminated by Digital Engine at any time, in Digital Engine's sole discretion.

 

Digital Engine may, at any time and in its sole discretion, without prior notice to you, modify, suspend or discontinue the platform or any portion thereof, or impose new or additional terms or conditions with respect to your use of the platform. Such modifications, suspensions or discontinuations may be temporary or permanent. Digital Engine will not be liable to You or any third party for any modification, suspension or discontinuance of the platform.

 

You understand and agree that Digital Engine may, at any time, without prior notice to you, terminate the platform or any portion thereof, or terminate your access to or use of the platform or any portion thereof. Digital Engine will not be liable to You or any third party for any such termination.

 

You understand and agree that your use of the platform is at your sole risk and that the platform is provided on an "as is" and "as available" basis. Digital Engine does not warrant that the platform will be uninterrupted, error-free or free from viruses or other harmful code.

 

Digital Engine disclaims all warranties, express or implied, with respect to the platform, including, without limitation, any warranty of merchantability, fitness for a particular purpose or non-infringement.

 

In no event will Digital Engine be liable to You or any third party for any special, indirect, consequential, exemplary or punitive damages, including, without limitation, lost profits or lost data, even if Digital Engine has been advised of the possibility of such damages.

 

Digital Engine's maximum liability to You for all damages, losses and causes of action, whether in contract, tort (including, without limitation, negligence), or otherwise, will not exceed one hundred dollars ($100).

 

The platform is controlled and operated by Digital Engine from its offices in the United States of America. Digital Engine makes no representation that the platform is appropriate or available for use in other locations. If You access or use the platform from other jurisdictions, You do so at Your own risk and You are responsible for compliance with all applicable laws.

 

You agree to comply with all applicable laws, statutes, ordinances and regulations with respect to your use of the platform.
